You can:

  • • Use Owdyn to track your personal finances
  • • Cancel your subscription anytime (no lock-in)
  • • Delete your account anytime
  • • Export your data (CSV — available on all plans)
  • • Contact us for help or support

You can't:

  • • Share your account with others
  • • Abuse the service or violate laws
  • • Copy, resell, or reverse engineer Owdyn
  • • Hold us liable for your financial decisions
  • • Rely on AI outputs without verification

AI category suggestions and insights may be wrong. Always review before accepting. Owdyn provides informational insights, not financial advice.

1. Agreement to Terms

By creating an Owdyn account or using the service, you agree to these Terms of Service ("Terms"). If you don't agree, please do not use Owdyn.

These Terms are a legal agreement between you and OWDYN LIMITED (NZBN: 9429053482907, trading as "Owdyn") ("we", "us", or "our"), a company incorporated in New Zealand.

By using Owdyn, you also agree to our Privacy Policy, Security Policy, and Cookie Policy.

2. What Owdyn Is (and Isn't)

Owdyn IS:

A personal finance tracking application that helps you:

  • Track financial accounts and balances
  • Log income and expenses
  • Categorize transactions (manually or with optional AI suggestions)
  • Set and monitor budgets
  • View spending insights and trends
  • Manage bills and subscriptions (features vary by plan)

Owdyn is NOT:

  • • A bank or financial institution
  • • A licensed financial adviser
  • • Regulated by the Reserve Bank of New Zealand
  • • A guarantee of financial success or outcomes

Important: Owdyn does not hold, move, or manage your money. Your funds stay in your actual bank accounts.

3. Who Can Use Owdyn

To use Owdyn, you must:

  • Be at least 13 years old (or 16 in the EU)
  • Have the legal capacity to enter into a binding agreement
  • Provide accurate registration information
  • Not be prohibited from using the service under applicable laws

For users under 18: We recommend getting parental consent before using financial tracking tools.

4. Your Account & Security

You are responsible for:

  • Keeping your password secure and confidential
  • All activity under your account (even if unauthorized)
  • Notifying us immediately of suspected unauthorized access: support@owdyn.nz
  • Enabling two-factor authentication (strongly recommended)
  • Not sharing your account with others

Account Suspension or Termination

We may suspend or terminate accounts that violate these Terms, abuse the service, or engage in fraudulent activity. We'll notify you when possible but reserve the right to act immediately if necessary.

5. Acceptable Use Policy

You agree NOT to:

Prohibited Activities

  • • Violate any laws or regulations
  • • Harm, threaten, or harass others
  • • Submit false or misleading information
  • • Use Owdyn for illegal financial activity
  • • Create multiple accounts to bypass limits
  • • Share accounts with others

Technical Restrictions

  • • Attempt to hack or breach security
  • • Scrape or collect data without permission
  • • Reverse engineer or copy Owdyn's software
  • • Use Owdyn to build a competing product
  • • Submit malicious code or viruses
  • • Overload or disrupt the service

AI Features - Acceptable Use

When using AI features, you must also comply with Anthropic's Usage Policy. This prohibits using AI to generate harmful, illegal, or abusive content.

6. Plans, Pricing & Billing

Available Plans

  • Owdyn Free: $0/month forever — 3 accounts, up to 6 budgets, 2 goals, 5 AI category suggestions/month
  • Owdyn Plus: NZD $6.99/month or NZD $69/year — 10 accounts, unlimited budgets and goals, 50 AI category suggestions/month, custom categories, bank auto-sync, cashflow forecasting
  • Owdyn Wise: NZD $14.99/month or NZD $149/year — unlimited accounts, budgets and goals, unlimited AI suggestions, full AI features, advanced analytics, Excel export

⚠️ Auto-Renewal Notice

Your subscription automatically renews until you cancel:

  • Monthly plans: Renew on the same day each month — we'll email you 5 days before renewal
  • Annual plans: Renew on the same day each year — we'll email you 30 days before renewal so you have adequate time to decide
  • • You authorize automatic charges to your payment method on renewal
  • • Cancel anytime in Settings → Subscription — access continues until the end of your paid period

Payment Processing

All payments are processed securely by Stripe:

  • We never see your full credit card number
  • Stripe is PCI-DSS Level 1 certified (highest security standard)
  • Payment information is encrypted end-to-end
  • You can update payment methods in Settings or via Stripe's portal

Cancellation

  • Cancel anytime with one click (Settings → Subscription)
  • No phone calls or hassle required
  • Access continues until the end of your current billing period
  • Your paid features are removed and your account reverts to Owdyn Free
  • All your data remains safe (nothing is deleted)

Failed Payments

If your payment fails:

  • Stripe will automatically retry (up to 3 times over 7 days)
  • You'll receive email notifications
  • If payment continues to fail, your paid features are removed and your account reverts to Owdyn Free
  • Your account reverts to Owdyn Free and your data remains intact — you can resubscribe at any time

Price Changes

We may change subscription prices with 30 days' advance notice:

  • We'll email you before the change takes effect
  • New price applies at your next renewal
  • You can cancel before renewal if you don't accept the new price
  • Existing subscriptions are not changed mid-cycle

GST

All prices listed are in New Zealand dollars (NZD) and are inclusive of Goods and Services Tax (GST) at 15%, where GST applies. Owdyn will issue GST-compliant invoices/receipts upon request.

6A. Refunds & Remedies

Cancellation Refunds

Owdyn subscriptions are billed in advance. When you cancel:

  • You retain access until the end of your current paid period — no partial-month refunds are issued for voluntary cancellations
  • Your account reverts to Owdyn Free at period end and your data is preserved
  • Annual subscribers who cancel within 14 days of their initial purchase (not renewal) may request a pro-rata refund by contacting support@owdyn.nz

Service Failure Remedies

Under the Consumer Guarantees Act 1993, if Owdyn fails to provide a service with reasonable care and skill, or the service is not fit for purpose as described, you are entitled to a remedy. Depending on the nature and severity of the failure:

  • Remediable failure: We will fix the issue or re-perform the affected service at no additional charge within a reasonable time
  • Substantial or unremedied failure: You may cancel your subscription and receive a pro-rata refund for the unused portion of your subscription period
  • Consequential loss: Nothing in these Terms excludes your right to claim for losses you suffer as a direct result of a failure on our part, where those losses were reasonably foreseeable

How to Request a Refund or Remedy

Contact us at support@owdyn.nz with a description of the issue. We'll respond within 3 business days and work with you to reach a fair resolution.

Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or other applicable NZ consumer protection law.

7. Your Data & Privacy

You own your financial data. We process it only to provide the Owdyn service.

Your data handling is governed by our Privacy Policy. Key points:

  • We never sell your data to third parties
  • We use encryption to protect your data
  • You can export your data anytime (CSV format, available on all plans)
  • You can delete your account and data anytime
  • AI providers (Anthropic) don't train models on your data

You are responsible for the accuracy of data you enter and for reviewing AI suggestions before accepting them.

8. AI Features & Limitations

AI Features Available

Owdyn offers optional AI-powered features including:

  • Category suggestions for transactions
  • Spending insights and pattern detection
  • Duplicate transaction detection
  • Bill and subscription detection
  • Natural language queries (Owdyn Wise, coming soon)

⚠️ CRITICAL: AI Outputs May Be Inaccurate

By using AI features, you acknowledge and agree that:

  • AI is not perfect: Category suggestions and insights may be wrong, incomplete, or misleading
  • You must verify: Always review AI outputs before accepting them
  • No guarantees: We don't guarantee the accuracy of AI-generated content
  • Not financial advice: AI insights are informational only, not professional financial advice
  • Your responsibility: You are responsible for all financial decisions, not the AI
  • Independent verification required: Don't rely on AI outputs without checking their accuracy

AI Service Provider

AI features are powered by Anthropic's Claude. When you use AI features:

Service Availability

AI features:

  • May be temporarily unavailable due to technical issues
  • May be modified, limited, or discontinued at any time
  • Are subject to monthly usage limits: Free — 5 suggestions/month; Plus — 50 suggestions/month; Wise — unlimited
  • Depend on third-party services (Anthropic)

For Financial Advice

AI insights are NOT a substitute for professional financial advice. For personalized financial guidance, tax advice, or investment recommendations, please consult a qualified financial adviser, accountant, or tax professional.

9. Service Availability & Maintenance

"As Is" Service

Owdyn is provided "as is" and "as available" without guarantees of:

  • • Uninterrupted access (we may have downtime)
  • • Error-free operation (bugs happen)
  • • 100% accuracy of calculations or insights
  • • Specific uptime percentage (we aim for high availability but can't guarantee it)

Maintenance

We may perform maintenance that temporarily interrupts service:

  • Scheduled maintenance: We'll notify you in advance when possible
  • Emergency maintenance: May happen without notice
  • Expected downtime: Typically less than 2 hours

Service Suspension

We may suspend or limit your access if:

  • Your account violates these Terms
  • We detect potential security threats or abuse
  • Required by law or court order
  • Technical issues require it for system protection
  • Your payment has failed (for Plus and Wise subscribers)

We'll try to notify you in advance when possible.

Third-Party Dependencies

Owdyn relies on third-party services (Vercel for hosting, Neon for database, Anthropic for AI, Stripe for payments, Canny for feedback management). If these services experience outages or issues, Owdyn may be affected. We're not liable for third-party service disruptions.

Owdyn is a tracking tool, not a financial adviser. We provide informational insights based on your data, but these are NOT financial, investment, tax, or legal advice. You are solely responsible for your financial decisions.

NO ACCURACY GUARANTEES

We don't guarantee that calculations, categorizations, AI suggestions, or insights are error-free or accurate. Always verify important information independently.

NO WARRANTY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OWDYN IS PROVIDED "AS IS" WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

THIRD-PARTY SERVICES

Owdyn uses third-party services (Stripe, Anthropic, Vercel, Neon, Canny). We're not responsible for their outages, errors, data breaches, or service changes.

NO BANK OR REGULATOR

Owdyn is not a bank, payment processor, or regulated financial institution. We don't hold, move, or manage your money. We're not supervised by the Reserve Bank of New Zealand or other financial regulators.

11. Limitation of Liability

What We're NOT Liable For

To the maximum extent permitted by New Zealand law, we are NOT liable for:

  • • Financial decisions you make based on Owdyn data or AI insights
  • • Inaccurate transaction data you enter
  • • Errors in AI category suggestions, insights, or calculations
  • • Service interruptions, downtime, or data loss
  • • Damages from third-party services (Stripe, Anthropic, Canny, etc.)
  • • Consequential, indirect, special, or incidental damages
  • • Lost profits, business opportunities, or savings
  • • Unauthorized access to your account (if due to your negligence)

Maximum Liability Cap

To the extent we are liable for any damages, our total liability is limited to the greater of:

  • The amount you've paid us in the last 12 months, OR
  • NZD $100

NZ Consumer Guarantees Act

Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or other mandatory consumer protection laws. If we fail to meet guarantees under the Act (e.g., services not fit for purpose), you may be entitled to remedies including refunds or compensation.

Exceptions

These limitations don't apply to:

  • Gross negligence or willful misconduct by Owdyn
  • Fraud or fraudulent misrepresentation
  • Liability that cannot be excluded by law
  • Death or personal injury caused by our negligence

12. Changes to These Terms

We may update these Terms from time to time. Changes will be effective 30 days after we notify you, except:

  • Changes required by law take effect immediately
  • Changes that benefit you may take effect sooner

We'll notify you of changes via:

  • Email to your registered address
  • In-app notification
  • Notice on this page

Continued use of Owdyn after changes take effect means you accept the new Terms. If you don't agree, you can cancel your account before the changes take effect.

13. Account Termination

You Can Cancel Anytime

To delete your account:

  • Go to Settings → Account → Delete Account
  • Confirm deletion — this is immediate and permanent and cannot be undone
  • Optional: Export your data first via Settings → Export Data (available on all plans)

What Happens to Your Data

  • Immediately: Your account and all associated data are permanently deleted. This cannot be undone.
  • After account deletion: Anthropic deletes your transaction data per their Data Processing Addendum
  • Day 90: Backup systems purged

We strongly recommend exporting your data before deleting your account. Deletion is permanent and irreversible.

We Can Terminate for Cause

We may terminate or suspend your account if:

  • You violate these Terms
  • You engage in fraudulent or illegal activity
  • You abuse the service or harm other users
  • Required by law or court order
  • We discontinue the service entirely

We'll provide notice when possible, but reserve the right to act immediately for serious violations.

Effect of Termination

  • You lose access to Owdyn immediately
  • Your data is deleted per the schedule above
  • Outstanding subscription fees remain due
  • Sections that should survive (e.g., liability limitations) remain in effect

14. Governing Law & Dispute Resolution

Governing Law

These Terms are governed by the laws of New Zealand, without regard to conflict of law principles.

If You Have a Dispute

Before going to court, please try these steps:

  1. Contact us first: Email support@owdyn.nz
  2. Good faith negotiation: We'll try to resolve the issue informally within 30 days
  3. Mediation (optional): If negotiation fails, we can try mediation

Court Proceedings

If informal resolution doesn't work:

  • Small claims: Use Disputes Tribunal of New Zealand (for claims under NZD $30,000)
  • Larger disputes: Courts of Auckland, New Zealand have exclusive jurisdiction
  • You agree to submit to the jurisdiction of New Zealand courts

Class Actions

To the extent permitted by law, you agree to resolve disputes individually, not as part of a class action or representative proceeding.

15. General Legal Stuff

Entire Agreement

These Terms, together with our Privacy Policy, Security Policy, and Cookie Policy, constitute the entire agreement between you and Owdyn.

Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force.

No Waiver

Our failure to enforce any right or provision doesn't constitute a waiver of that right or provision.

Assignment

You may not transfer or assign your rights under these Terms. We may assign our rights to an affiliate or successor.

Force Majeure

We're not liable for delays or failures due to circumstances beyond our reasonable control (e.g., natural disasters, pandemics, wars).

Survival

Provisions that should survive termination (e.g., liability limitations, governing law, data deletion) remain in effect.
